Welcome to FoxReach. These Terms of Service ("Terms") govern your use of the FoxReach platform, website, and services (collectively, the "Service") operated by FoxReach ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Account Terms

You must be at least 18 years old to use this Service. You are responsible for maintaining the security of your account and password. FoxReach cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You are responsible for all activity that occurs under your account, including content sent through email campaigns. You must not use the Service for any illegal or unauthorized purpose.

2. Email Sending & Anti-Spam Policy

FoxReach is designed for legitimate cold email outreach. By using our Service, you agree to comply with all applicable email laws, including but not limited to:

• The CAN-SPAM Act (United States)
• The General Data Protection Regulation, GDPR (European Union)
• Canada's Anti-Spam Legislation, CASL (Canada)
• Any other applicable local, state, national, or international laws

You agree that you will:

• Only send emails to recipients who have not explicitly opted out
• Include accurate sender information and a valid physical address
• Honor unsubscribe requests promptly (within 10 business days)
• Not use deceptive subject lines or misleading header information
• Not send emails containing malware, phishing links, or harmful content
• Not harvest, scrape, or purchase email lists from unauthorized sources

Violation of this anti-spam policy may result in immediate account suspension or termination without refund.

3. Acceptable Use

You may not use FoxReach to:

• Send spam, bulk unsolicited emails, or phishing emails
• Impersonate any person or entity
• Transmit viruses, malware, or any code of a destructive nature
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any purpose that is illegal or prohibited by these Terms

4. Payment & Billing

Paid plans are billed in advance on a monthly or annual basis. Payments are non-refundable except as required by law. You may cancel your subscription at any time, and your account will remain active until the end of the current billing period.

We reserve the right to change our pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

5. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you upload to FoxReach, including leads, email templates, and campaign content. We do not sell or share your data with third parties for marketing purposes.

6. Email Account Credentials

When connecting email accounts via App Passwords, your credentials are encrypted at rest and in transit. We use these credentials solely to send emails on your behalf and manage your warmup pool. You may disconnect your accounts at any time.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any downtime or service interruptions caused by factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, FoxReach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, resulting from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your account at any time for violation of these Terms, with or without prior notice. Upon termination, your right to use the Service will immediately cease. You may export your data within 30 days of termination.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
